CRIMINAL LIABILITY FOR NEGLIGENCE RESULTING IN FATAL CONSEQUENCES: A COMPARATIVE ANALYSIS OF TWO REGIMES OF THE KUHP

Negligence resulting in fatal consequences is a form of criminal liability that carries serious implications, as it relates directly to the protection of the right to life. The regulation of negligence under the former Indonesian Criminal Code (KUHP) is considered insufficient due to its general formulation and the absence of clear distinctions regarding degrees of negligence, which often creates uncertainty in law enforcement. Indonesia introduced reforms through the new Criminal Code to clarify the elements of fault, strengthen the boundaries of criminal liability, and provide more proportional and humane sanctions. The findings of this study indicate that the new Criminal Code brings significant improvements to legal certainty, victim protection, and the effectiveness of punishment that is more responsive to social and technological developments. Furthermore, the adoption of restorative justice mechanisms in the new Criminal Code provides better recovery opportunities for victims and their families. Therefore, this comparison emphasizes that criminal law reform is crucial to reducing sentencing disparities and enhancing the quality of law enforcement related to fatal negligence in Indonesia.
